General sales conditions
Article 1 - Purpose
These general terms and conditions of sale (hereinafter "GTC") govern the contractual relationship between any user of the website https://www.pfttsp.be and the customer and Patrimoine Ferroviaire et Tourisme (hereinafter "the Seller"), for any purchase made on the website [insert name of website] (hereinafter "the Site").
Article 2 - Products
The products offered for sale are those shown on the Site on the day the Customer consults the Site. Each product is accompanied by a detailed description. The photographs illustrating the products are not contractual.
Article 3 - Prices
Product prices are indicated in euros, inclusive of all taxes. Delivery costs are indicated to the Customer before the order is validated. The Vendor reserves the right to modify its prices at any time, but the products will be invoiced on the basis of the rates in force at the time the order is validated.
Article 4 - Ordering
The Customer may place an order on the Site by following the instructions. Validation of the order implies acceptance of these GCS. The Seller will confirm the order by email.
Article 5 - Payment
Payment is made online by credit card or via a secure payment system such as PayPal. Orders will only be dispatched once payment has been received.
Article 6 - Delivery
Products are delivered to the address indicated by the customer at the time of ordering. The delivery time is 10 working days, managed by volunteers. The Seller is not responsible for delays caused by third parties.
Article 7 - Right of withdrawal
The Customer has a period of 14 days from receipt of the product to exercise his right of withdrawal, without having to justify his decision or pay any penalties. The Customer must inform the Vendor of his decision to withdraw in an unambiguous statement (e.g. letter sent by post, fax or e-mail). The Customer must return the product to the Vendor within 14 days of informing the Vendor of his decision to withdraw. The cost of returning the product is borne by the Customer. The Vendor will reimburse the Customer for all sums paid, including delivery costs, within 14 days of receipt of the returned product.
Article 8 - Warranty
Products are guaranteed against defects of conformity and latent defects for a period of 2 years from delivery. In the event of a lack of conformity or hidden defect, the Customer must inform the Vendor as soon as possible. The Vendor undertakes to repair or replace the defective product.
Article 9 - Liability
The Vendor cannot be held responsible for indirect damage resulting from the use of the product. The Seller's liability is limited to the amount of the order.
Article 10 - Personal data
The personal data collected during the ordering process is used to process the order and manage customer relations. In accordance with the French Data Protection Act of January 6, 1978, customers have the right to access, rectify and delete their personal data.
Article 11 - Intellectual property
All elements of the Site are protected by copyright and trademark law. Any reproduction, representation, modification, publication, adaptation of all or part of the elements of the Site, whatever the means or process used, is forbidden.
Article 12 - Applicable law and jurisdiction
These GTC are governed by Belgian law. Any dispute relating to the interpretation or execution of these GTC shall be submitted to the exclusive jurisdiction of the Belgian courts.
Article 13 - Modification of the GCS
The Vendor reserves the right to modify these terms and conditions at any time. The terms and conditions applicable are those in force on the day the order is validated.
